1. Introduction

This Privacy Policy describes how the Mugdha Realty Sales CRM Application ("App") collects, receives, stores, uses, processes, discloses, transfers, protects, and retains information relating to authorised users, employees, representatives, business partners, administrators, customers, leads, prospects, and other persons whose information may be processed through the App.

The App is operated by Mugdha Realty ("Mugdha Realty", "Company", "we", "us", or "our"), which is the data controller responsible for information processed through the App. The App is developed, maintained, and supported on the Company's behalf by Nexvista Technologies Pvt Ltd as its technology provider.

The App is a private business application intended exclusively for authorised business use by persons permitted by Mugdha Realty. It is not a public-facing application and is not intended for general public access.

By accessing, installing, logging into, or using the App, the user acknowledges that he/she has read, understood, and agreed to this Privacy Policy and consents to the collection, use, storage, processing, disclosure, transfer, and retention of information in accordance with this Privacy Policy and applicable law.

Where any specific permission, consent, or approval is required under applicable law, including in relation to notifications or processing of personal data, such consent may be obtained separately through the App, employment terms, contractual arrangements, internal policies, or other legally valid means.

2. Scope and Applicability

This Privacy Policy applies to all authorised users of the App, including employees, sales representatives, business partners, administrators, consultants, contractors, and any other persons authorised by Mugdha Realty to access or use the App.

This Privacy Policy also applies to personal data and business information relating to customers, leads, prospects, property enquiries, site visits, communications, and other CRM-related records processed through the App.

User accounts are created, approved, controlled, suspended, or deactivated only by authorised administrators of Mugdha Realty. Self-registration is not available unless expressly enabled by the Company.

The App is not intended for use by persons below eighteen (18) years of age. By accessing or using the App, the user represents that he/she is at least eighteen (18) years old and legally competent to use the App.

Use of the App is subject to this Privacy Policy, applicable terms of employment or engagement, internal company policies, confidentiality obligations, data protection requirements, and applicable laws of India.

3. Information We Collect

In connection with the operation, administration, security, maintenance, and use of the App, Mugdha Realty may collect, receive, generate, store, process, and retain the following categories of information:

A. Personal Data of Users

We may collect personal information relating to authorised users of the App, including:

Full name;
Email address;
Mobile number;
Employee identification details;
User role, designation, permissions, and access rights;
Login credentials and authentication information;
Profile photographs or images voluntarily uploaded by users.

User accounts are created and managed exclusively by authorised administrators. Self-registration is not available unless specifically enabled by the Company.

B. Authentication and Security Information

To facilitate secure access to the App, authentication credentials, security tokens, session identifiers, device identifiers, and related security information may be generated and securely stored through platform-specific security mechanisms, including Apple Keychain (iOS) and Android Keystore (Android).

Such information is processed solely for authentication, account management, access control, fraud prevention, cybersecurity, and system security purposes.

C. Business and CRM Information

The App enables authorised users to create, access, manage, update, and process business-related information on behalf of Mugdha Realty. Such information may include:

Lead and prospect information;
Customer names and contact details;
Email addresses and postal addresses;
Property preferences and requirements;
Budget and pricing information;
Site visit information;
Follow-up records;
Business partner and inventory information;
Communication history;
Sales and transaction records;
Internal notes and observations.

Users acknowledge that such information belongs to Mugdha Realty and is processed solely for legitimate business purposes.

D. Activity Monitoring and Audit Information

For operational, compliance, security, and business management purposes, the App may automatically generate and maintain activity logs and audit records, including:

Login and logout activity;
User access history;
Download activity;
Upload activity;
File-sharing records;
CRM record creation and modification history;
Administrative actions;
Security events;
Device access logs;
Date, time, and user account associated with any activity.

Users expressly acknowledge and consent to such monitoring, logging, review, auditing, and retention activities.

E. Device and Technical Information

The App may automatically collect technical and diagnostic information, including:

Device model;
Device operating system;
Operating system version;
Application version;
Device identifiers;
Error reports;
Crash logs;
Performance metrics;
Network information;
Diagnostic information.

Such information is used exclusively for security, maintenance, troubleshooting, analytics, and service improvement purposes.

F. Images and Media Content

Where a user voluntarily uploads, captures, attaches, downloads, or shares photographs, images, brochures, documents, marketing materials, announcements, or other media through the App, the App shall access only the specific content selected by the user.

The App does not continuously monitor, scan, analyse, or access unrelated content stored on the device.

G. Push Notification Information

The App may generate and store push-notification tokens and related identifiers through services such as Firebase Cloud Messaging (FCM) or equivalent notification platforms for the purpose of delivering alerts, reminders, operational messages, and system communications.

H. Cached and Offline Content

To improve performance and user experience, certain images, brochures, marketing materials, and application resources may be temporarily cached or stored locally on the user's device.

Such locally stored content remains subject to the security controls of the user's device and may be removed through application settings, device settings, or uninstallation of the App.

4. Information We Do Not Collect

Unless expressly stated in this Privacy Policy or specifically enabled by the user, the App does not:

Collect precise GPS location information;
Continuously track user movements or location history;
Access SMS messages;
Access personal contact lists or address books;
Access personal emails;
Collect biometric identifiers or biometric authentication information;
Use advertising identifiers for targeted advertising;
Display third-party advertisements;
Incorporate behavioural advertising or profiling technologies;
Sell or commercially exploit personal information.

The App accesses device permissions only to the extent necessary for authorised business functions and legitimate operational requirements.

Where mapping or navigation services are made available, such functionality may redirect users to third-party map applications selected by the user. Such third-party services are governed by their own privacy policies and terms of use.

5. Purpose of Collection and Processing

Information collected through the App may be processed for one or more of the following lawful purposes:

A. User Administration and Authentication

Creating and managing user accounts;
Authenticating authorised users;
Managing permissions and access controls;
Maintaining account security.

B. CRM and Business Operations

Managing leads, customers, prospects, and business opportunities;
Recording customer interactions;
Managing property information, inventory, and sales processes;
Managing business partner relationships;
Facilitating communication between authorised users and customers;
Generating operational insights.

C. Security and Compliance

Detecting unauthorised access attempts;
Preventing fraud, misuse, data theft, and cybersecurity incidents;
Maintaining audit trails and compliance records;
Monitoring compliance with company policies and contractual obligations;
Investigating complaints, disputes, or misconduct.

D. Performance, Maintenance and Improvement

Diagnosing software issues;
Monitoring application performance;
Improving functionality and user experience;
Maintaining operational stability and security.

E. Legal and Regulatory Compliance

Complying with applicable laws and regulations;
Responding to lawful requests from governmental authorities;
Protecting legal rights and interests;
Establishing, exercising, or defending legal claims;
Complying with contractual obligations and regulatory requirements.

6. Legal Basis for Processing Personal Data

Mugdha Realty processes information only on lawful grounds recognised under applicable law, including the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, and other applicable laws. Personal Data may be processed on one or more of the following legal bases:

A. Consent

By accessing or using the App, users consent to the collection, storage, processing, disclosure, transfer, and retention of Personal Data in accordance with this Privacy Policy. Where required by law, additional or specific consent may be obtained for particular processing activities.

B. Employment and Contractual Necessity

Processing may be necessary for:

Employment administration;
Business partner management;
Contract performance;
Customer relationship management;
Service delivery;
Business communications;
Operational management.

C. Legitimate Business Interests

Mugdha Realty may process information where reasonably necessary for legitimate business interests, including:

Business administration;
Network and information security;
Fraud prevention;
Internal investigations;
Quality control;
Performance monitoring;
Risk management;
Protection of company assets;
Enforcement of contractual obligations.

D. Legal and Regulatory Obligations

Information may be processed where required to comply with applicable laws, court orders, regulatory directions, governmental requests, audit requirements, tax obligations, and corporate compliance obligations.

Withdrawal of Consent

Where processing is based upon consent, users may withdraw consent by submitting a written request to the Grievance Officer. Withdrawal of consent shall not affect:

Processing conducted prior to withdrawal;
Processing required by law;
Processing required for contractual performance;
Processing required to protect legal rights and interests.

Users acknowledge that withdrawal of consent may result in suspension, restriction, or termination of access to certain App functionalities or services.

Data Principal Rights

Subject to applicable law, users may exercise the following rights:

Right to access information relating to personal data processing;
Right to correction and updating of inaccurate information;
Right to completion of incomplete information;
Right to erasure of personal data where legally permissible;
Right to grievance redressal;
Right to withdraw consent;
Right to nominate another individual to exercise rights in accordance with applicable law.

Requests relating to such rights may be submitted to the Grievance Officer designated under this Privacy Policy.

7. Sharing and Disclosure of Information

Mugdha Realty does not sell, rent, lease, trade, or otherwise commercially exploit Personal Data for monetary consideration. Information may be disclosed only where reasonably necessary for legitimate business, operational, legal, contractual, security, or regulatory purposes. Information may be shared with the following categories of recipients:

A. Authorised Personnel

Personal Data and Business Information may be accessed by authorised directors, officers, employees, administrators, consultants, auditors, legal advisors, and authorised representatives of Mugdha Realty on a need-to-know basis.

B. Service Providers and Technology Partners

Information may be disclosed to Nexvista Technologies Pvt Ltd as the Company's technology provider, and to other third-party service providers engaged for:

Application development, maintenance, and support;
Cloud hosting;
Data storage;
Notification services;
Security services;
Technical support;
Analytics and system monitoring;
Infrastructure management;
Disaster recovery and backup services.

Such service providers shall be contractually obligated to maintain confidentiality and implement reasonable security measures, and to process information solely on the Company's behalf.

C. Corporate Transactions

Information may be disclosed in connection with a merger, acquisition, corporate restructuring, investment transaction, sale of assets, or business transfer, provided that appropriate confidentiality and data protection obligations are imposed upon the receiving party.

D. Legal and Regulatory Requirements

Information may be disclosed where disclosure is reasonably necessary to comply with applicable law, comply with judicial orders, respond to governmental or regulatory requests, investigate fraud or unlawful activities, or protect the rights, property, safety, security, reputation, or legitimate interests of Mugdha Realty, its users, customers, or third parties.

8. Cross-Border Data Transfers

Information processed through the App may be stored, accessed, transferred, processed, or backed up on systems located within or outside India. Where Personal Data is transferred outside India, Mugdha Realty shall implement appropriate contractual, organisational, technical, and security safeguards designed to ensure an equivalent level of protection consistent with applicable law.

Users acknowledge and consent to such international processing, storage, transmission, backup, and transfer activities where required for operation of the App and related services. Nothing in this Privacy Policy shall be interpreted as permitting transfers prohibited by applicable law.

9. Data Security and Protection Measures

Mugdha Realty, together with its technology provider, implements commercially reasonable administrative, organisational, physical, and technical safeguards designed to protect information against accidental, unlawful, or unauthorised access, disclosure, alteration, destruction, misuse, loss, theft, or damage. Security measures may include:

HTTPS and TLS encrypted communications;
Secure authentication mechanisms;
Role-based access controls;
Device-level credential protection;
Encryption of sensitive data where appropriate;
Security monitoring and logging;
Network security controls;
Periodic vulnerability assessments;
Backup and disaster recovery procedures;
Access management controls.

Users are responsible for maintaining the confidentiality of their login credentials and for taking reasonable precautions to secure their devices.

While reasonable efforts are implemented, no system, software application, communication network, or method of electronic storage can be guaranteed to be completely secure. Accordingly, Mugdha Realty does not warrant or guarantee absolute security.

Data Breach Management

In the event of an actual, suspected, or reasonably foreseeable data breach, cybersecurity incident, unauthorised disclosure, loss, theft, destruction, corruption, or compromise of information, Mugdha Realty may investigate the incident; take corrective and containment measures; suspend access where necessary; notify affected parties where required by law; notify competent authorities where legally required; and implement remediation and security improvements.

Nothing in this Privacy Policy shall be construed as an admission of liability arising from any security incident.

10. Data Retention and Deletion

Mugdha Realty shall retain information only for as long as reasonably necessary for legitimate business purposes, contractual obligations, legal compliance, dispute resolution, security investigations, regulatory requirements, audit requirements, and enforcement of legal rights. The retention period may vary depending upon the nature of the information, business requirements, legal obligations, regulatory requirements, ongoing investigations, and litigation hold requirements.

Upon expiration of the applicable retention period, information may be deleted, permanently anonymised, or archived in accordance with applicable law.

Notwithstanding any account deletion request, Mugdha Realty may retain information where retention is necessary to comply with law, defend legal claims, comply with regulatory requirements, maintain audit trails, prevent fraud and misuse, or enforce contractual obligations.

Locally cached content stored on user devices may be removed through device settings, application settings, or by uninstalling the App.

10A. Employee, Business Partner and Business Monitoring Notice

The App is a business communication, sales management, customer relationship management, and operational platform owned, controlled, and administered by Mugdha Realty. Users acknowledge and agree that all activities conducted through the App are undertaken in the course of business and may be monitored, supervised, reviewed, audited, recorded, retained, analysed, and investigated by Mugdha Realty. Such monitoring may include, without limitation:

Login and access activity;
CRM data creation, modification, export, and deletion;
Customer interactions and communications;
File uploads, downloads, and sharing activities;
User activity logs and audit trails;
Device access records;
Security events and compliance records.

Such monitoring is undertaken for legitimate business purposes including business administration; employee and business partner supervision; customer service quality assurance; fraud prevention and detection; information security; cybersecurity protection; regulatory compliance; internal investigations; protection of confidential information; protection of intellectual property; enforcement of contractual obligations; and dispute resolution and evidentiary purposes.

Users acknowledge that information created, stored, transmitted, processed, or accessed through the App constitutes business information belonging to Mugdha Realty and that users shall have no expectation of privacy with respect to business activities conducted through the App, except to the extent expressly required by applicable law. Nothing contained herein shall be construed as authorising unlawful monitoring or surveillance prohibited under applicable law.

11. User Rights and Data Principal Rights

Subject to applicable law, users and Data Principals may exercise the following rights in relation to their Personal Data:

Right to obtain information regarding the processing of Personal Data;
Right to access Personal Data maintained by Mugdha Realty;
Right to request correction, updating, or completion of inaccurate or incomplete Personal Data;
Right to request erasure of Personal Data where legally permissible;
Right to withdraw consent where processing is based upon consent;
Right to grievance redressal;
Right to nominate another individual to exercise rights in accordance with applicable law in the event of death or incapacity.

Requests relating to Personal Data may be submitted to the Grievance Officer identified in this Privacy Policy. Mugdha Realty reserves the right to verify the identity and authority of any person submitting a request before taking action. Requests may be refused, restricted, or delayed where permitted by applicable law, including where compliance would adversely affect legal obligations, ongoing investigations, security interests, regulatory compliance, or the rights of third parties.

12. Account and Data Deletion

This section applies to the Mugdha Realty — Sales CRM Application. Authorised users (or, for employee and business-partner accounts, the user's organisation or an authorised administrator) may request deletion of their account and associated personal data at any time.

How to request deletion

Please include: the registered name on the account, the registered email address and/or mobile number, and the user ID if known, so we can verify the request.

Steps:

Email the above address with the subject line "Account Deletion Request".
We acknowledge the request and verify the identity of the requester.
On successful verification, we delete or anonymise the eligible data and confirm completion to you.

We aim to acknowledge requests within seven (7) days and to complete verified deletion within thirty (30) days, except where a longer period is required or permitted by applicable law.

Data that is deleted

On a verified request, we delete or irreversibly anonymise the following personal data associated with the user account:

User profile information (name, email address, mobile number, employee identification, role and designation);
Login credentials and stored authentication tokens;
Profile photographs and images voluntarily uploaded by the user;
User-level application preferences and settings.

Where optional features that rely on device identifiers (such as push notifications) are enabled in a future release, any related identifiers (for example, push-notification tokens) collected for those features will likewise be deleted or anonymised on a verified request. The current release does not collect push-notification tokens or device identifiers.

Data that may be retained

The App is a business platform, and certain records belong to Mugdha Realty rather than to the individual user. Deletion of a user account does not automatically delete such records. The following may be retained for the periods stated and then deleted, anonymised, or archived in accordance with applicable law:

CRM and business records (leads, customer details, property and sales information, communication history, internal notes) — retained as company business records for as long as needed for legitimate business purposes;
Transaction and financial records — retained for the period required under applicable tax, accounting, and corporate law;
Audit logs, security logs, diagnostic and crash logs, and compliance records — retained for security, stability, audit, and legal-defence purposes;
Any data that must be retained to comply with law, respond to lawful requests, or establish, exercise, or defend legal claims.

Where retention is no longer required, the relevant data is deleted or permanently anonymised. Where deletion is not legally permissible, data may be retained, archived, restricted, or anonymised in accordance with applicable law.

Mugdha Realty reserves the right to suspend, disable, restrict, or terminate user accounts at any time for security, operational, compliance, contractual, disciplinary, or business reasons.

13. Permissions Requested by the App

The App may request access to certain device permissions solely for legitimate business and operational purposes.

Internet / Network Access

Required for communication with application servers, CRM services, notifications, updates, security controls, and related functionality.

Notifications

Required to deliver alerts, reminders, follow-up notifications, operational messages, and other application-related communications.

Camera

Optional permission used only when users voluntarily choose to capture images or upload photographs through the App.

Photos, Media and Storage

Used only when users voluntarily choose to upload, download, save, view, share, export, import, or access files, images, brochures, documents, or marketing materials through the App. The App does not continuously monitor, scan, analyse, or access unrelated content stored on the device.

Users may manage permissions through their device settings. Certain features may not function correctly if required permissions are denied.

14. Third-Party Services and Integrations

The App is developed and maintained by Nexvista Technologies Pvt Ltd and may utilise third-party services, infrastructure providers, software vendors, cloud-hosting providers, messaging services, storage providers, security vendors, analytics providers, or other technology partners to facilitate operation of the App. Such service providers may process information solely for authorised operational purposes and subject to contractual confidentiality, security, and data-protection obligations. Examples may include:

Application development and technology services (Nexvista Technologies Pvt Ltd);
Cloud hosting providers;
Firebase Cloud Messaging (FCM);
Data and object storage providers;
Security and monitoring platforms;
Disaster recovery providers;
Customer communication platforms.

Mugdha Realty does not control the independent privacy practices of third-party platforms operating under their own privacy policies. Users acknowledge that interactions with third-party services may also be governed by the terms, privacy policies, and data-processing practices of such third parties.

The App does not include third-party advertising networks, behavioural advertising SDKs, social-media tracking SDKs, or advertising identifiers for targeted advertising purposes.

15. Changes to this Privacy Policy

Mugdha Realty reserves the right, at its sole discretion, to amend, revise, modify, update, supplement, replace, or remove any portion of this Privacy Policy at any time. Any such changes shall become effective upon publication within the App, on the Company's website, or through any other reasonable method of communication determined by the Company.

Where required by applicable law, users may be notified of material changes through notifications, email communications, or other appropriate means. Continued access to or use of the App following publication of any revised Privacy Policy shall constitute acceptance of the revised Privacy Policy. Users who do not agree with any modification to this Privacy Policy must discontinue use of the App and may request account deactivation in accordance with applicable procedures.

16. Grievance Officer

In accordance with applicable laws, including the Digital Personal Data Protection Act, 2023, users may submit complaints, grievances, requests, or concerns relating to Personal Data, privacy rights, data processing, consent withdrawal, correction requests, deletion requests, or any other privacy-related matter to the Grievance Officer.

The Company shall endeavour to acknowledge and address grievances within a reasonable period and in accordance with applicable legal requirements. Nothing in this section shall limit the rights of Data Principals under applicable law.

17A. Limitation of Liability

To the maximum extent permitted by applicable law, Mugdha Realty, Nexvista Technologies Pvt Ltd, and their respective directors, officers, employees, affiliates, licensors, technology providers, service providers, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or economic losses arising from:

Use of or inability to use the App;
Service interruptions or downtime;
Telecommunications failures;
Internet failures;
Cyberattacks, malware, ransomware, or hacking incidents;
Unauthorised access to information by third parties;
Data loss, corruption, or destruction;
Errors, omissions, delays, or inaccuracies in information;
User misconduct or misuse of the App;
Actions of third-party service providers.

The aggregate liability of Mugdha Realty arising out of or relating to this Privacy Policy shall, to the maximum extent permitted by law, not exceed the amount paid by the user, if any, for access to the App during the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in this Privacy Policy shall exclude liability that cannot be excluded under applicable law.

18. Governing Law, Dispute Resolution and Jurisdiction

This Privacy Policy shall be governed by, interpreted, and construed in accordance with the laws of India. Any dispute, controversy, claim, question, disagreement, or difference arising out of or relating to this Privacy Policy, the App, the processing of Personal Data, user rights, obligations of the parties, or any matter connected therewith shall, as far as possible, be resolved amicably through good-faith discussions between the parties.

If the dispute is not resolved within thirty (30) days from the date on which written notice of the dispute is issued by either party, the dispute shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a Sole Arbitrator appointed by Mugdha Realty. The seat and venue of arbitration shall be Hyderabad, Telangana, India. The arbitration proceedings shall be conducted in the English language. The arbitral award shall be final and binding upon the parties and may be enforced by any court of competent jurisdiction.

Nothing contained in this clause shall prevent Mugdha Realty from seeking interim, injunctive, equitable, protective, or conservatory relief before any court having competent jurisdiction. Subject to the arbitration provisions contained herein, the courts at Hyderabad, Telangana, India shall have exclusive jurisdiction in respect of interim relief proceedings; applications under the Arbitration and Conciliation Act, 1996; enforcement of arbitral awards; execution proceedings; judicial review proceedings permitted by law; and any matter ancillary or incidental to arbitration. The parties expressly waive any objection based upon territorial jurisdiction, forum non conveniens, or similar grounds and agree that Hyderabad, Telangana, India shall be the exclusive forum for such proceedings.
